1. Acceptance of Terms

By accessing or using Canoë Interpretation's services via any of our platforms or subdomains (collectively referred to as the "Platform"), including:

You agree to be bound by these Terms and Conditions of Use (hereinafter the "Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing these sites.

2. Description of Services

Canoë Interpretation provides a suite of AI-powered language interpretation services for healthcare and other critical settings.

2.1 Scope of Services

Our services include different interpretation modalities accessible via our subdomains, specifically:

General Interpretation (App): Interpretation for standard interactions.
Simultaneous Interpretation (Simo): Continuous real-time translation for conferences or meetings.
Conversational Interpretation (Talk): Tools designed to facilitate direct dialogue.

2.2 Common Features

Multilingual support (40+ languages)
Noise cancellation options
Audio transcription and temporary playback

2.3 Specialist Mode

Certain services offer a "Specialist" mode using enhanced verification for higher accuracy. However, this does not guarantee 100% accuracy. Please refer to Section 3 for important disclaimers.

3. AI Interpretation Disclaimer

IMPORTANT: Canoë Interpretation uses artificial intelligence. While we strive for high accuracy, AI interpretation (whether consecutive or simultaneous) is not infallible and may contain errors, omissions, or misinterpretations.

3.1 For Healthcare and Critical Settings

Canoë is a communication aid, not a replacement for certified human interpreters.
Users should verify critical information through qualified professionals.
Do not rely solely on AI interpretation for life-or-death decisions, medical diagnoses, or legal matters.
Note for Simultaneous Mode (Simo): The speed of simultaneous interpretation may increase the risk of minor inaccuracies compared to consecutive interpretation.

3.2 No Professional Advice

Canoë Interpretation does not provide medical, legal, or professional advice. The service facilitates communication only.

4. Subscription and Billing

4.1 Free Minutes

New accounts may receive free interpretation minutes. These minutes are not transferable between different accounts or subdomains unless otherwise stated.

4.2 Paid Subscriptions

After exhausting free minutes, continued use requires a paid subscription. Details of available plans are displayed in the relevant application.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled.

4.4 No Rollover

Unused minutes from a subscription period do not roll over to the next period. At the start of each billing cycle, your balance resets according to your plan's allocation.

4.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

4.6 Refunds

Refund requests may be made within 14 days of the initial purchase by contacting [email protected]. No partial refunds are provided for mid-cycle cancellations.

5. Acceptable Use

5.1 Permitted Use

You may use the Platform for lawful interpretation purposes in personal, professional, healthcare, or institutional contexts.

5.2 Prohibited Use

You agree NOT to:

Use the Service for any illegal purpose;
Share account credentials with unauthorized parties;
Attempt to circumvent usage limits or billing;
Reverse engineer, decompile, or copy the source code;
Overwhelm or interfere with the Service's infrastructure (e.g., DDoS attacks);
Use the Service to process content that violates applicable laws.

6. Privacy Policy

Your use of all Canoë Interpretation subdomains is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

The content, features, and underlying technology of app, simo, and talk.canoeinterpretation.com are owned by Canoë Interprétation Inc. and are protected by international copyright and intellectual property laws.

You retain ownership of the content you submit (voice/text). You grant us a limited license to process this content solely for providing the service.

8. Termination

We may terminate or suspend your access to all or part of the Platform immediately, without prior notice, for any reason whatsoever, including without limitation if you breach these Terms.

9. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY QUEBEC LAW, CANOË INTERPRÉTATION INC. SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages;
Loss of profits, data, use, goodwill, or other intangible losses;
Damages arising from interpretation errors (consecutive or simultaneous);
Any damages exceeding the amount paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Canoë Interprétation Inc. from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

11. Service Availability

The Platform is provided "as is" and "as available." We do not guarantee uninterrupted operation, particularly in cases of internet connectivity issues, maintenance, or third-party API failures.

12. Governing Law

These Terms shall be governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Longueuil, Quebec.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice. Continued use of the Service constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
